2015 Proposed Changes to The Constitution and Bylaws

Update: With results from the June 16th GMM

In accordance with the local's Constitution and By-laws, resolutions to amend the constitution may be presented by a member at any meeting, after which they will be turned over to the Constitutional Committee for recommendations.  They are then printed, with the committee's recommendations, in the newsletter and voted on at the June General Membership Meeting.

 

This year, six resolutions have been submitted, which are printed below with the recommendations of the committee.   They will be voted upon at the General Membership Meeting on Tuesday, June 16, 2015 at 7 PM.

 

RESOLUTION NO. 1

Submitted by Robert J. Armentani

Art. IV - Officers

Whereas the local continues to lose money consistently each year despite the many attempts that have been made to cut expenses, the South Jersey Area Local has been in financial crisis for several years and it continues to worsen.

Whereas the membership has shrunk considerably over the past 10 years causing less due intake.

Whereas the local has not been able to afford sending delegates to conventions, craft conferences or been able to provide necessary training.

Be it resolved the current officer salaries will be cut by 10%.

 RESULTS: Resolution #1 Passed at June 16th GMM

RESOLUTION NO. 2

Art. V - Committees and Shop Steward

Whereas the local continues to lose money consistently each year despite the many attempts that have been made to cut expenses, the South Jersey Area Local has been in financial crisis for several years and it continues to worsen.

Whereas the membership has shrunk considerably over the past years causing less dues intake.

Whereas the local has not been able to afford sending delegates to conventions, craft conferences or been able to provide necessary training.

Be it resolved to amend the language of Article V.B(1) from,

"He/she will be reimbursed for payment of dues in the amount of $400.   When the steward pays to the local exceeds $400, the steward will receive the equivalent amount the steward pays to the Local for their dues reimbursement"

to read:   "Regular stewards will be reimbursed for payment of dues in the amount of $400 and those designated as alternated steward will  be reimbursed for payment of dues in the amount of $200."

RESOLUTION NO. 3

Art IV - Officers

Whereas the local continues to lose money consistently each year despite the many attempts that have been made to cut expenses, the South Jersey Area Local has been in financial crisis for several years and it continues to worsen.

Whereas the membership has shrunk considerably over the past years causing less dues intake.

Whereas the local has not been able to afford sending delegates to conventions, craft conferences or been able to provide necessary training.

Whereas it is apparent that the local can no longer afford to hold 2 full time officer positions on the executive board.

Whereas the amendment proposed will save the local a considerable amount of money per year, up to approximately $50,000.

It is proposed to amend the language of Article IV.1 President as follows

It is proposed to remove the language "He/She shall be a full time officer" from Article IV.1 President.

COMMITTEE RECOMMENDATION:  NON-CONCURRENCE

 RESULTS: Resolution #3 was Amended at the June 16th GMM to include to modify the resolution to only be in effect for 1 term. The amendment passed followed by the passage of the ammended resolution.

 

RESOLUTION NO. 4

Art. IV - Officers

Be it resolved that under Article IV.4, (Business Agent) it is proposed to delete the following language "He/She shall be a Full-time officer", from Article IV.4

COMMITTEE RECOMMENDATION:  NON-CONCURRENCE

Reason:  There is enough work to justify and necessitate a full-time Business Agent.  The Union office should be staffed during business hours so that members have access to the union.  Many Associate Offices do not have stewards, and these members, as well as Bellmawr members, need access to the Local when they need information, or need assistance with an urgent matter, without having to play phone tag.  The Local needs to work closely with the national office, and national officers need to be able to communicate with the Local during business hours.  (Note: Although the Committee is not in agreement with this proposal, we believe that before the resolution is voted upon, it should be amended so that it takes place with the next term in office unless the incumbent full-time Business Agent prefer to revert to part-time).

RESOLUTION NO. 5

Art. IV - Officers

Whereas the local continues to lose money consistently each year despite the many attempts that have been made to cut expenses, the South Jersey Area Local has been in financial crisis for several years and it continues to worsen.

Whereas the membership has shrunk considerably over the past years causing less dues intake.

Whereas the local has not been able to afford sending delegates to conventions, craft conferences or been able to provide necessary training.

Whereas the amendment proposed will save the local a considerable amount of money per year up to approximately $20,000 should a retired person be elected to the position of Business Agent.

Where the current language of Article IV.4 Business Agent reads:

He/She shall be a full time officer, and shall be paid for lost time, plus a yearly salary equal to that of the clerk craft directed $5448, and all necessary official Union expenses.

It is proposed to change the language of Article IV.4 Business Agent to read:

He/She shall be a full time officer, and shall be paid for lost time, plus a yearly salary equal to that of the clerk craft director $5448.  Unless He/She is retired from the Postal Service, in which case He/She will be paid a salary equivalent to a level PS 6 pay step O of the pay scale in effect while holding office, and all necessary official Union expenses.\

RESOLUTION NO. 6

Art VI - Officers and Members Benefits

Whereas should the proposed change to Article IV.4 Business Agent pass then the following proposed change to Article VI.2 also be submitted.

Whereas the language of Article VI.2 reads:

2. All full time officers shall be granted twenty six (26) days annual leave and sick  leave as needed per year.

It is proposed to change the language of Article VI.2 to read:

2. All non-retired full time officers shall be granted twenty six (26) days annual leave and sick leave as needed per year.
